Fault in Truck Accidents

Was the truck driver at fault?

This is one of the first questions our clients ask us. The answer isn't always simple or straightforward. The experienced trucking-accident attorneys at the Lowe Law Firm will look at a range of factors to identify fault. These factors include:

  • Driver fatigue;
  • Inattention on the part of the truck driver;
  • Aggressive driving behavior, such as tailgating or speeding, on the part of the truck driver;
  • Improper truck or trailer maintenance;
  • Improper loading of cargo;
  • Driving with an unsecured load;
  • Use of amphetamines or other drugs by the truck driver;
  • Tire-tread separation or tire blowout;
  • Negligent driving in bad weather conditions;
  • Negligent passing;
  • The role of the truck in obscuring a motorist's view;
  • Jackknifing and rollovers on slippery roads.

Our attorneys use a variety of tools to gather evidence and ultimately answer the question of fault. The truck's black box is one such tool. This data recorder gathers information on fuel consumption, hard-braking events, top and average speeds and time spent idling and on cruise control. We also review the trucking company's global positioning satellite (GPS) records, which not only reveal the truck's location and movement but can also be used to determine whether the truck's log book was altered after the accident.

The accident scene itself provides many clues to the events leading up to the crash. Along with the black-box and GPS data, accident reconstructionists review eyewitness statements, skid marks, and the positions of the vehicles after the crash to answer the question of fault. Because this evidence can be destroyed, it is important to contact a lawyer as soon as possible after an accident.
